This Offer (the “Offer”) is available to all users who download the Gaana App on their iOS or Android based mobile phones & do a registration using Facebook email ID till the Offer is displayed on www.Gaana.com. (“Offer Period”). The Gaana app (“Gaana”), is currently a free music streaming service from Times Internet Limited (TIL).
2. User who downloads the Gaana app & register through his/her Facebook email ID will get free Rs.50 recharge coupon from Paytm (“Coupon”), subject to the User must have minimum 90 days old Facebook account & at least 10 friends in his/her friend’s list prior to date of downloading the Gaana app & registration under this Offer.
3. Users need to redeem Rs. 50 recharge coupon through their Paytm app only and shall be subjected to deduction of applicable taxes, duties and or levies as per the Terms and Conditions of the respective telecom operator. A user needs to verify his/ her Paytm account (email and phone) to be able to use the coupon. The Paytm app would refer to the Paytm application downloaded by the users on their iOS or Android mobile phones.
4. This offer is also applicable for Post-Paid mobile customers who download the Gaana app as mentioned above. The Post-Paid customers can use the Coupon as per the time limit specified by their respective telecom operator.
5. Rs. 50 Recharge coupon, can be used for single or in tranches . For utilization in tranches, the Coupon once used will be tagged to the user’s device/mobile number for the balance amount and will not be permitted to be used by any other user/device/mobile number.
6. Rs. 50 Recharge coupon can be used/redeemed only by one User/Email/Mobile number.
7. The coupon can be utilized against Post-paid, Prepaid Mobile , DTH & Data Card transactions on Paytm app. Further, the Coupons shall be utilized, subject to the availability of denominations and Billing process with the respective service operator or circle.

19. This offer is exclusive to any other offer run by the Company and is non-transferable. No substitution will be given nor shall any exchange or redemption for an equivalent cash amount or in any other form be allowed under any circumstances.
20. The Company shall not be responsible or liable for any failure, error, omission or delay in transmission of any message or transaction in relation to the offer for any reason whatsoever. The decision as regards the receipt or non-receipt of messages, or the success or failure of transactions shall solely lie with the Company and its partners and shall be treated as conclusive for all purposes.

24. The Company is neither responsible nor guarantees the quality of the services being offered as redemption nor is liable for any defect or deficiency of goods or services so obtained/availed, by the subscribers under this offer.
25. The benefits under the offer are neither assignable nor transferable under any circumstances. All the prizes shall be subject to such other terms and conditions as may be applicable to specific prizes and shall have to be duly complied with by the User who is awarded with the Coupons (“Winner”).

The user agrees to indemnify, defend and hold harmless the Company, its subsidiaries, affiliates and agents and each of their respective officers, directors, employees, successors and assigns from and against any claim, proceeding, loss, damage, liability, cost, demand or expense (including but not limited to attorney’s fees) of any kind arising out of: (i) any breach by the user of their obligations under these terms; (ii) User’s violation of the rights of a third party, including but not limited to infringement of any intellectual property, proprietary right or trade secret of any person or entity, or of any privacy or consumer protection right that is implicated herein; (iii) any violation of law or contractual obligation and any claims, demands, notices pursuant to such violation; (iv) User’s negligence or wilful misconduct.
    The Company shall not be liable to the user for any eventuality caused directly or indirectly by any act of God, wars (declared or undeclared), insurrections, acts of terrorism, acts of governments or boycotts, lockouts and other civil unrest, or any act of similar nature beyond the Company’s reasonable control.
35. Even if one or more provisions of these terms are held to be unenforceable under applicable law(s), the remainder of these terms shall be valid and enforceable. These terms and conditions are governed by Indian Laws. All disputes arising out of this offer shall be subject to the jurisdiction of courts at New Delhi.
