Eligibility:

The Contest is open to all individual participants (“Participant(s)”) who:

are citizens of India and residing in India;
are above eighteen (18) years of age as on the start date of the Contest Period

Contest Period:

The contest name is “Oxy Daawat Contest”
The Contest Period shall commence from 22nd Feb 2015 and shall conclude on 31st May 2015 at (“Contest Period”).
Entries (defined below) received after the Contest Period shall not be entertained and shall be considered ineligible for the Contest.
This contest is being run through 3 platforms on TV program “Farah Ki Daawat”, on Facebook (www.facebook.com/kenstarindia) and on the company website (www.kenstar.in).
The Participant may participate in this contest through any of the above platforms, and the Winners will be selected among all the participants participating thorough all above platforms

Mode and Manner of the Participation Mechanism (“Mechanism”):

Kenstar shall telecast promos and/or aston bands during its Program with a question (“Contest Question”) along with the four options for the correct answer (“Option”) and details about the mechanism of the participation in the Contest. The Participant shall strictly adhere to the mechanism laid therein as well as stated in these Terms and Conditions to participate in the Contest.
The Participants who are interested in participating and qualifying i.e. eligible for the Contest (as mentioned above) will have to send a SMS containing the correct option to the Contest Question. The SMS should contain the keyword “oxy” followed by <space> followed by the correct Option to the Contest Question “A/B/C/D” and should send it to “9902099020” in order to participate in the Contest (“Entries”).
Participants shall submit their Entries strictly in accordance with the Terms and Conditions mentioned herein.
There shall be no restriction on the number of Entries sent by the Participants. For the sake of clarity the Participants can send unlimited number of Entries for the Contest.
The cost charged to the Participant(s) per SMS shall be the service charge as may be as applicable by the respective mobile operators. Neither Kenstar nor the Channel shall be responsible to reimburse any such cost incurred by the Participant or any loss/charges incurred in case of any network problems such as breakdown of machinery, unclear network, disruption in the network and/or any excess cost charged by the network operator. Any dispute in connection to the same shall be settled between the Participants and the network operator without involving Kenstar and Channel.

Conditions in relation to Participation/Entries:

By participating in the Contest, the Participants agree to be bound by any rules, regulations, guidelines or policies (“Rules “) associated with the Contest including but not limited to the adherence of the third party platforms like network operators etc. due to their usage in relation to the Contest.
The Participants confirm that the Entries shall not be obscene, vulgar, defaming, denigrating women, artist, celebrity or children, hurting religious sentiments, depicting violence or against the public policy of India.
Kenstar reserve the right to disqualify the Participants immediately from the Contest if Participants have supplied untruthful, inaccurate or misleading details and/or information, of any nature and/or have failed to abide by the Rules and/or are in breach of the terms hereof.

Mode of Selection and Prize Details:

Kenstar shall, on its sole discretion, select one (1) Participant who is in complete adherence to the Contest’s Terms and Conditions and Rules contained herein as the grand winner of the Contest (“Grand Winner”). Grand Winner will get a chance to be part of the show, “Farah ki Daawat”
In addition to Grand Winner, Kenstar at its sole discretion shall select 14 Participants on a random basis who are in complete adherence of all Rules herein (“Consolation Prize Winners”). The said participants will get Farah Ki Daawat Recipe Book.

For the sake of reference, both Grand Winner and Consolation Prize Winners are together referred hereinafter as “Winner”.

The Winner shall be announced within 10 (ten) days from the end of the Contest Period unless otherwise deemed fit by Kenstar. The Winner shall be intimated in a manner as deemed fit by Kenstar. Kenstar shall shortlist those Participants among all participants, who have sent the correct answer through any platform (Facebook/TV Contest/website) and shall further select the Winner. Mere participation in the Contest by sending the Entries does not entitle the Participants to win the Contest or the Prize. The selection process may vary and shall be as per Kenstar’s sole discretion. The Participants or any third party shall have no right to question the process of selection. Kenstar shall at its sole discretion determine the creativity, correctness, quality and validity of the Entries.
After the Winner is announced, the Winner is required to approach Kenstar, in a manner, determined by Kenstar, within 7 (Seven) days of announcement by Kenstar and confirm the acceptance of the Prize along with providing requisite details, copy of citizenship proof, identity proof and address proof, etc. of the Winner.
If the winner fail to contact Kenstar as set out in paragraph above, the email/direct message sent to the winner is returned as undeliverable or the winner declines the prize, the winner will be disqualified and a new winner will be considered for the same.
Kenstar shall not entertain any questions, correspondence, enquiries on the manner of conduct of the Contest and grant of the Prize from any party whatsoever.
Kenstar reserves the right to choose another participant/ winner in the event of disqualification/rejection of any of the participant/ winner

Conditions with relation to the Prize:

The Winner expressly agrees that in addition to these Terms and Conditions the Winners shall comply with any Terms and Conditions that may be stipulated by Kenstar along with their respective parent, subsidiary, and affiliate companies or any third party in relation to the receipt of the Prize.
Kenstar shall not be responsible for any loss of entries for any reason, whatsoever including, due to any problems caused by telephone lines, service providers, network breakdowns, computer service delays, interruptions, network failures or overloads, or for lost, misdirected or misplaced entries, or for entries received after the Contest Period or for any reasons beyond the control of Kenstar.
In the event of unforeseen circumstances beyond the control of KENSTAR, and the Prize not being made available to the Winner, the Winner shall not have the right to claim any damages or monies from Kenstar and by participating in this Contest the Winner waives his/her right to make any such claims against Kenstar its employees, subsidiary, and affiliate companies or any third party.
Income tax, gift tax or any other statutory taxes, duties or levies as may be applicable from time-to-time, arising out of the Prize, shall be borne and paid by the Winner. In case the Winner fails to comply with the applicable laws or pay the requisite taxes, duties or levies, if any, the Winner shall indemnify Kenstar of any losses, claims, expenses, costs and actions for the same.
The Participants hereby agree and confirm that all decisions of Kenstar in connection with participation and selection, in the Contest, are final and binding and are non-contestable. The Participants shall neither question such process nor dispute the same in any manner. In case of any dispute or difference in respect of above, decision of Kenstar shall be final and binding on all parties/persons.

Representations and warranties by the Participants/ Winner(s):

The Participants acknowledge that they do not have any medical, physical and/or emotional condition which can jeopardize their eligibility for participation in the Contest.
The Participants hereby agree and undertake that mere announcement/declaration of being announced as a Winner shall not entitle him/her to the Prize. Only upon fulfilling all Rules mentioned herein, to the satisfaction of Kenstar, shall the winning be validated.
Kenstar has the right to dismiss participant’s entry at its sole discretion including but not limited to pertaining any of the following conditions:
Use of false or other people’s personal information for entry.
Using of any software program or unfair means or any other means to get added advantage over the other contestants.

General Conditions:

The Prize shall not be transferable, negotiable and/or redeemable for cash. No request shall be entertained by Kenstar in this behalf. Only the Winner and no other person can claim the Prize for or on behalf of the Winner.
The Participants should not have criminal conviction or an arrangement or a contract that prevents the Participants from participating in the Contest.
The Participants in whose name the mobile number (from which the message is sent) is registered with a network operator shall be construed to have sent the SMS. Consequently, the Winner whose name the mobile number (from which the message is sent) is registered with a network operator shall be entitled to the Prize
To enable registration of a Participant and/or to make the Prize available to the Winner, personally identifiable information which may include without limitation name, complete address, date of birth, citizenship details, email id, etc. of the Participants/Winner (“Personal Information”) will be collected by Kenstar to enable Kenstar to administer and promote this Contest and the Winner. If Participants do not truthfully provide all requested Personal Information, Kenstar may determine that such Participants are not eligible to win the Prize in this Contest.
All information entered by the Participant for contesting in the Contest or for registration under this contest shall be subject to Privacy Policy of Kenstar and said information may be used by the Kenstar for its brand promotion
Taking part in the registration process shall be deemed to be consent by the Participants/Winner(s) to receive promotional messages about the shows and programs of Kenstar and messages relating to the Program from Kenstar or any third party so authorized by Kenstar.
Kenstar shall not be responsible for the quality or deficiency of the Prize and no claim or request, whatsoever, in this respect shall be entertained by Kenstar.

In the event of unforeseen circumstances beyond the control of Kenstar, Prize is not made available to the Winner, or the Prize is cancelled, the Winner shall not have the right to claim any damages or monies from Kenstar and by participating in this Contest the Winner waives his/her right to make any such claims against Kenstar its employees, subsidiary, and affiliate companies or any third party..

Kenstar shall not entertain any questions, correspondence, enquiries on the manner of conduct of the Contest and grant of the Prize from any party whatsoever.
All information provided in the Contest is provided “as is” without warranty of any kind. Kenstar make no representations and disclaims all express, implied and statutory warranties of any kind to the Participants and/or the Winner and/or any third party including, without limitation, warranties as to accuracy, timeliness, completeness, merchantability, or fitness for any particular purpose.
Under no circumstance, shall Kenstar and/or its parent, subsidiaries, associates, affiliates and group entities, and their respective directors, employees, officers, agents or representatives be liable to the Participants and/or the Winner and/or any third party for any lost profits or lost opportunities, indirect, special, consequential, incidental, or punitive damages whatsoever, even if Kenstar has been advised of the possibility of such damages. The Participants and the Winner specifically agree not to file in person/through any family member and/or any third party any applications, criminal and/or civil proceedings in any courts or forum in India against Kenstar, its parent, subsidiaries, associates, affiliates and group entities, and their respective directors, employees, officers, agents or representatives to claim any damages or relief in connection with the Contest.
It is the Participants’ responsibility to ensure that their Personal Information is always updated and accurate in order to be able to receive the gratification/notification in time.
Kenstar may at any time, at its discretion, change these Terms & Conditions, the contest page, the Rules and/or the Prize mentioned herein, without prior notice.
The Participants and the Winner acknowledge that they will not hold Kenstar /or any of their affiliates or agencies engaged by them with regard to this Contest liable for any loss of opportunity and/or monetary loss due to their participation in the Contest.
The Participants hereby agrees and confirms that it shall fully indemnify and hold harmless Kenstar along with their affiliates/group companies/ respective directors/ employees etc., against any loss, claims, dispute, disruption etc., caused due to any act or omissions or misrepresentations, or concealment of material facts or breach hereof by the Participants.
By participating in the Contest and accepting the Prize, the Winner waives all copyrights and any related rights and consents to Kenstar’s right to click photographs, take pictures, shoot audio-visuals, tape, record, exhibit or portray him/her as the Contest Winner and/or publish any content/Entries submitted by him/her. The Winner further grants irrevocable consent in perpetuity to use, edit, exhibit, publish and/or exploit the same, in any and all applications including advertising, commercials, promotion, stories, text, illustrations, articles and commercial exploitation, throughout the world, in any and all media, mode or format whether now existing or hereinafter developed, including but not limited to radio, broadcast and television, newspapers, magazines, and electronic media, at any time without the Winner’s further knowledge or consent and without any compensation whatsoever.
Kenstar reserve the right to terminate, modify or extend this Contest, and its Terms and Conditions, at any time at its absolute discretion, without assigning any reason whatsoever. In case of any dispute or difference in respect of this Contest, decisions of Kenstar shall be final, binding and irrevocable.
The invalidity or unenforceability for any reason of any part of these Terms & Conditions shall not prejudice or affect the validity or enforceability of the remaining parts and each part of these Terms & Conditions is distinct and at all times severable from the rest of the Terms & Conditions.
No waiver of any rights by Kenstar will be taken as a waiver of any other rights it may have. For instance, if Kenstar waives its right to object to a particular breach of these Terms and Conditions by a Participant, it does not prevent Kenstar from objecting to any other breaches by that Participant or any other Participant.
In case of any dispute or any other matter arising in reference to the Contest, Kenstar (depending on the nature of dispute) shall first try to resolve the same at their end and the decision of Kenstar shall be binding on the other party (ies)/Participants/Winners.
The Contest shall be subject to the exclusive jurisdiction of competent Courts at Aurangabad (Maharashtra) and the law applicable shall be Indian Law.
Participation in this Contest implies acceptance and compliance of all the Terms & Conditions of the Contest.
